After a meeting between prosecutors and Kayla, the defense received a “Zwicker letter” detailing purported changes and additions to her account of the circumstances surrounding Harmony’s death. This letter, according to court documents, prompted the defense to argue that the state’s portrayal of the charges as part of a “sustained pattern of abuse” created unfair prejudice, warranting separate trials.
Judge Amy Messer, however, rejected this argument, citing significant overlap between the two sets of charges. Her order emphasized the commonality of both the perpetrator, Adam Montgomery, and the victim, Harmony Montgomery, in both cases, as well as the central role of Kayla Montgomery as a witness in both instances.
